We are glad you would like to order from us or plan your event with us. These terms cover both cases — choose the relevant section below.

Shop and online purchase

1. Subject Matter

The ice cream café offers various ice cream flavours, food items and other products for sale. The exact scope of the ordered products is determined by your order.

2. Order and Contract Conclusion

2.1. Your order via an online platform constitutes a binding offer to conclude a purchase contract.

2.2. The contract is concluded as soon as we confirm your order, begin preparing it, or receive your payment — whichever of these three events occurs first.

2.3. The ice cream café reserves the right to reject orders without giving reasons, in particular in cases of product unavailability or reasonable suspicion of abusive ordering.

3. Prices and Payment Terms

3.1. The stated prices are final prices including the statutory value-added tax.

3.2. Payment is due immediately upon ordering. Accepted payment methods are displayed on the ordering platform (e.g. debit card, credit card, online payment services).

4. Pick-up

4.1. Products must be collected within the agreed or usual pick-up times at the ice cream café. Products not collected, especially those requiring refrigeration, may be disposed of after a reasonable waiting period (approx. 2 hours) at the customer's risk, without any right to a refund.

4.2. For larger orders (from €150), the pick-up time may shift slightly to ensure our usual product quality.

5. Quality and Defects

5.1. The ice cream café places the utmost importance on the quality and freshness of its products.

5.2. Obvious defects (e.g. wrong order, damaged packaging) must be reported immediately upon receipt. Later complaints cannot be considered for perishable goods.

5.3. In the case of justified defects, you are entitled to replacement or a reduction in the purchase price. Further claims are excluded to the extent permitted by law.

6. Allergen Information and Ingredients

6.1. Allergens and ingredients are listed at the ice cream café or on our website. Please inform yourself about potential allergens before placing your order.

6.2. The ice cream café accepts no liability for allergic reactions resulting from the customer's failure to observe allergen information. Despite utmost care, cross-contamination cannot be completely ruled out.

7. Right of Withdrawal

Our products are ice cream and food items that are freshly prepared and perishable, as well as, for individually composed orders, goods made to the customer's specification. Pursuant to § 312g(2) No. 1 and No. 2 BGB (German Civil Code), no statutory right of withdrawal exists for these products.

8. Liability

8.1. The ice cream café is liable without limitation for damages resulting from intent or gross negligence.

8.2. For slight negligence, the ice cream café is liable only for breach of essential contractual obligations (cardinal obligations); in such cases, liability is limited to the contractually typical, foreseeable damage.

8.3. The ice cream café accepts no liability for damages caused by force majeure, power failure, or other circumstances beyond its control.

9. Data Protection

The processing of your personal data is governed by our Privacy Policy.

⚡ The Essentials at a Glance
💌 Your booking request is not yet a contract – it only becomes binding once we have both confirmed it (see point 2.2).
💶 Minimum revenue: €500.00 — travel, setup/dismantling and staff are already included. If we're already nearby, or for times between 21:30 and 22:00 close to our route, a lower amount may also be possible — see points 3.5 and 3.6.
📅 In case of cancellation, a staggered fee applies depending on the notice given, see point 4.

We look forward to making your event a special highlight with our ice cream. To ensure everything runs smoothly, here are our "ground rules" for a great collaboration.

1. What We Do for You (Subject Matter)

We bring the joy of ice cream directly to you! Our catering includes delicious ice cream, the right accessories and – if booked – our friendly team for serving. The exact details are set out in your personal order confirmation.

2. Your Path to Ice Cream Catering (Offer & Contract)

2.1. Our offers are initially an invitation to you and non-binding unless otherwise agreed.

2.2. Your booking request via our website is initially only a non-binding inquiry and does not yet constitute a contract. After reviewing your request, we will get back to you. A binding contract is only formed once you confirm our reply in turn and we give you our final confirmation.

2.3. Arrangements by phone or message are great – the same mutual confirmation described in point 2.2 still applies for them to become binding.

3. Prices, Payment & Our Promise (Minimum Revenue)

3.1. All prices include statutory VAT – no hidden costs.

3.2. Costs for travel, setup and dismantling, and staffing are already included in the minimum revenue of €500.00 and are not charged separately.

3.3. Our minimum revenue: To get our catering vehicle ready for you, we plan with a minimum revenue of €500.00. This amount covers ice cream and accessories up to this value. If your guests enjoy more, we charge each additional portion at the regular price. If less is consumed, we still charge the flat rate of €500.00 to cover our fixed costs and preparation.

3.4. Efficient service time: We are there for your guests as long as ice cream is being enjoyed! To make the best use of our resources and ensure operations at our gelateria, our service ends when the flow of guests stops. If no guest visits our ice cream stand for 20 minutes, we reserve the right to begin dismantling. The agreed minimum revenue remains unaffected, as all logistics and preparation have already been completed for you.

3.5. For requests between 21:30 and 22:00, if possible on that day, we may in some cases be available even without the guaranteed minimum revenue of €500.00, provided the location is near our route or on our way back. For requests in this time window, please contact us exclusively by phone, not through the website. This is always subject to our individual confirmation, with no automatic entitlement.

3.6. If we happen to already be in your town that day, a short message is enough – by phone, SMS or WhatsApp, even at short notice the day before or on the same day. We will get back to you as soon as we know our availability. This also applies to smaller occasions (e.g. children's birthdays) and without the guaranteed minimum revenue of €500.00, though with no entitlement to availability.

3.7. The minimum revenue applies exclusively to private parties, subject to the exceptions set out in points 3.5 and 3.6. For public events (e.g. community festivals, town fairs), the minimum revenue does not apply – the price is agreed individually with you.

4. If Your Plans Change (Cancellation)

We prepare everything fresh for you. If you need to cancel, we charge the following percentages of the agreed price:

5. If We Have to Cancel (Only One Vehicle Available)

Being upfront with you: we currently operate with only a single ice cream van and have no replacement vehicle. Because of this, even for an already confirmed booking, it may rarely happen that we have to cancel at short notice — for example due to an accident, a breakdown (such as a flat tyre), or sudden illness of our staff. In the worst case, this can happen only a few minutes before the agreed time.

As soon as we become aware of such an incident, we will notify you without delay. Any deposit you have already paid will be refunded to you without delay and in full. Unfortunately we cannot accept further claims — for example for resulting costs — except in cases of intent or gross negligence on our part (see point 8).

6. Right of Withdrawal

Our ice cream catering is a service connected with a leisure activity for which your contract provides for performance on a specific date (your event), and also involves rapidly perishable goods (freshly prepared ice cream). Pursuant to § 312g(2) No. 9 and No. 2 BGB (German Civil Code), no statutory right of withdrawal exists for this booking. The cancellation fees stated in point 4 remain valid, as a separately agreed contractual arrangement for the case of cancellation by you.

7. On-Site Together (Your Role as Host)

7.1. Please provide a suitable space (level and dry surface) for our stand.

7.2. We take good care of our equipment – please do the same, you and your guests. You as host are liable for any damage that occurs during the event.

7.3. Compliance with legal requirements (e.g. youth protection) is your responsibility.

8. Our Responsibility (Liability)

We give everything for a perfect catering! We are liable without limitation for intent and gross negligence. For slight negligence, we are liable only for breach of essential contractual obligations (cardinal obligations); in such cases, liability is limited to the contractually typical, foreseeable damage. For things beyond our control (such as power cuts or bad weather) we unfortunately cannot accept liability.

9. Feedback & Complaints

9.1. We want you to be happy! If something is not right, please let us know immediately (no later than 1 hour after the end of the catering).

9.2. This allows us to respond directly. For fresh food products, later complaints unfortunately cannot be considered.

10. Your Data is Safe

Your data is in good hands with us. We use it exclusively to plan and carry out your catering perfectly. For details, see our dedicated privacy policy for van bookings.

Final Provisions (apply to both sections above)

The law of the Federal Republic of Germany applies.

The place of jurisdiction for all disputes is Achern, insofar as the customer is a merchant, legal entity under public law, or a special fund under public law.

Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall not be affected.
